Qui Tam Whistleblower Actions
Proven Counsel from Chicago Whistleblower Attorneys
Pavich Law Group, P.C., is proud to represent clients in whistleblower cases, also known as
Qui Tam cases. These cases are brought under the False Claims Act, a federal statute
allowing private citizens to file actions on behalf of the government
against federal contractors and other entities who have committed, or
are actively committing, fraud against the government. Essentially acting
on behalf of the federal government, individuals bringing
Qui Tam actions often have insider knowledge of false claims made by contractors
and typically involving health care (especially Medicare and Medicaid
fraud), military or other government programs.
Individuals who successfully bring a
Qui Tam action are entitled to receive some form of compensation, typically between
15-30% of the total recovery made by the government as a result of the case.
Procedurally, once a
Qui Tam action is filed, the federal government, acting through the Department
of Justice, determines whether to enter the lawsuit. However, even in
cases where the government declines to intervene, individuals may still
pursue their whistleblower claims, although recovery in such cases can
be more difficult.
The False Claims Act has been enormously successful in recovering fraudulently
obtained government funds, and also in deterring future fraudulent conduct
against the United States. Since the passage of the Act in 1863, more
than $27 billion has been recovered from actors accused of defrauding
the government.
Qui Tam actions may result from fraud in many different areas, including:
- Medicaid fraud
- Medicare fraud
- Government procurement fraud
- Defense and military industrial complex contractor fraud
- Federal grant fraud
- Public works projects funded by the government
- Attempts by U.S. companies to evade federal export/import taxes
Regardless of the area, an individual wishing to bring a
Qui Tam action must be represented by an attorney, as pro se actions are not allowed
under the Act. Quite obviously,
Qui Tam cases often involved sensitive and discreet investigations, requiring
an experienced team to investigate and prosecute the case.
The whistleblower attorneys and investigators at Pavich Law Group, P.C.,
